Merchco and its affiliates, including Merchco Construction Services, LLC, a Texas limited liability company (together, the “Merchco Family”), are committed to maintaining your confidence and trust as it relates to the privacy and use of your information. Please read below to learn how we collect, protect, share, and use your information in connection with our website and our marketing and informational activities.
1.2. This Privacy Policy applies to https://merchcoservices.com and to any other websites, landing pages, and online forms owned and operated by Merchco on which this Privacy Policy is displayed (collectively, the “Website,” “Site,” or the “Services”), as well as to Merchco Family affiliates. The Site is an informational and marketing website. It does not offer e-commerce, and it does not provide user accounts or logins.
1.3. By using the Site, you agree to the terms of this Privacy Policy. Please read this entire Privacy Policy before using or submitting information to us through this Site. When you submit information to us for example, when you complete our contact form or sign up to receive our newsletter or marketing communications, you consent to the collection, processing, use, and disclosure of that information in accordance with this Privacy Policy. If you do not agree to this Privacy Policy, you are not permitted to access or use the Site.
1.4. For purposes of this Privacy Policy, “Personal Information” means any information by which you can be individually identified, directly or in conjunction with other reasonably available information, including, without limitation, your name, postal or email address, telephone number, the content of any message you send us, and information collected automatically through cookies and similar tracking technologies (such as IP address and online-activity data). This Privacy Policy does not apply to information collected through offline channels, except where that information is consolidated with Personal Information collected through this Site. This Privacy Policy does not apply to any third-party website linked to this Site; Merchco is not responsible for the privacy practices or content of those third-party sites.

1.6. Consent Before Tracking. See Section 6 to learn how we obtain your consent before deploying analytics, session-replay, advertising, and chat technologies, and how you can grant or withdraw that consent.
1.7. Cookies and Interest-Based Advertising. See Section 6 and our separate Cookie Policy to learn more about how we use cookies and how to opt out of interest-based advertising.
2.1. Identifying and Contact Information. Your name, email address, telephone number, and any other information you choose to include when you complete our contact form or subscribe to our newsletter or marketing list.
2.2. Message and Inquiry Content. The content of the message, question, or request you submit through our contact form or by responding to our communications, together with any information you voluntarily provide about your project, property, or business needs.
2.3. Communications Data. Information about and contained in communications between you and us, including email, form submissions, records of your requests, and, where a chat or messaging feature is enabled and disclosed, the content of chat sessions.
2.4. Online Activity and Device Information. Information collected automatically through cookies and similar technologies, which may include internet protocol (IP) address, browser type, internet service provider, device type and operating system, referring and exit pages, pages viewed and links clicked, mouse movements, scrolling, clicks, and other interactions captured by analytics and session-replay tools, access times, and date/time stamps.
2.5. Inferences. Inferences drawn from the above to reflect your preferences and interests, used to improve the Site and to deliver relevant marketing.
2.6. Other Information. Aggregate or de-identified data that is not used to identify you.
3.1. Information Provided by You. You provide your Personal Information when you interact with us, such as when you complete our contact form (Name, Email, Phone, and Message), subscribe to our newsletter or marketing communications, or otherwise communicate with us. Because the Site does not offer accounts or e-commerce, we do not collect login credentials or payment card information through the Site.
3.2. Information from Cookies and Other Tracking Technologies. Subject to the consent requirements described in Section 6, we use cookies, web beacons, pixels, and similar technologies — including Google Analytics 4 (“GA4”) and Hotjar (a behavioral-analytics and session-replay tool) — to understand how the Site is used and to improve it. This information may include IP address, browser type, device information, referring/exit pages, clickstream and interaction data, and date/time stamps. We do not deploy these non-essential technologies until you have given the consent described in Section 6.
3.3. Information from Third Parties. We may receive limited information from marketing, advertising, and analytics partners, and from social-media platforms on which we advertise or maintain a presence, in each case consistent with those parties’ own privacy policies and with your consent where required.
4.1. Any Personal Information collected by Merchco may be used for the following purposes:

4.6. To detect, prevent, and respond to fraud, security incidents, and misuse of the Site.
4.7. To comply with applicable law and legal process, to enforce our Terms of Use, and to protect our rights, property, and safety and those of our users and the public.
4.8. To notify you about changes to the Site or to this Privacy Policy.
4.9. Where permitted by law and our arrangements with service providers, Merchco may combine the Personal Information you share through the Site with other information you have shared with us. Merchco uses this consolidated information to improve its Services, to communicate with you, to enhance marketing and research activities, and to carry out other legitimate business functions.
5.1. Merchco does not sell, rent, or lease its customer or visitor lists to third parties for money. Merchco may share Personal Information within the Merchco Family (including Merchco Construction Services, LLC). In addition, Merchco may share your Personal Information with outside third parties solely for the following purposes:
5.2. Service Providers. To share data with trusted service providers and processors who perform services on our behalf, including website hosting, form processing, email and newsletter delivery, analytics (GA4), behavioral analytics and session replay (Hotjar), advertising, and technical maintenance. These parties are permitted to use your Personal Information only to provide services to Merchco and are required to protect its confidentiality.
5.3. Advertising and Analytics Partners. Subject to your consent as described in Section 6, to share online-activity information with analytics and advertising partners so that we can measure and improve the Site and deliver relevant marketing. To the extent any such disclosure constitutes a “sale” or “share” under applicable state law, you may opt out as described in Sections 6 and 14.
5.4. Corporate Transactions. To facilitate a merger, consolidation, financing, transfer of control, or other corporate reorganization in which any member of the Merchco Family participates.
5.5. Legal and Safety. To respond to lawful requests from government authorities or as required by applicable law, court order, or legal process; to protect and defend the rights, property, or safety of the Merchco Family, our users, or the public; and in connection with the investigation of suspected or actual unlawful activity.
5.6. Audits and Investigations. Where needed for corporate audits or to investigate or respond to a complaint or security threat.
5.7. Any member of the Merchco Family with whom we share your Personal Information is required to treat it in accordance with this Privacy Policy. The privacy practices of other business partners are governed by their own privacy policies.
6.1. When you interact with the Site, we and our service providers use cookies and other tracking technologies — such as pixels, web beacons, tags, and session-replay scripts (collectively, “Cookies”) — to recognize your device, understand and analyze how the Site is used, remember your preferences (including your consent choices), promote security, and, where you consent, deliver and measure advertising.
6.2. Consent Before Non-Essential Tracking. We do not deploy non-essential Cookies or tracking technologies including GA4 analytics, Hotjar behavioral analytics and session replay, advertising and social-media pixels, and any chat or messaging tools until you have given affirmative, prior consent through our cookie-consent banner. Strictly necessary technologies (for example, those that store your consent preferences or protect the security of the Site) operate without consent because the Site cannot function without them. You may grant, decline, or withdraw consent at any time using the banner or the “Cookie Preferences” link in the footer of the Site. Withdrawing consent stops future non-essential tracking; it does not affect processing that already occurred while your consent was in effect.
6.3. Session Replay and Behavioral Analytics. Hotjar and similar tools may record your interactions with the Site (such as mouse movements, clicks, scrolling, and page navigation) to help us understand and improve the user experience. We configure these tools to suppress and mask sensitive fields and content wherever practicable, and we deploy them only after you consent. We do not use these tools to intercept the contents of private communications, and we do not enable them before consent is captured.
6.4. Chat and Messaging Tools. If we make a chat or messaging feature available on the Site, we will disclose it and will not load it before you have consented. Any prior chat tool that is no longer in use has been removed from the Site.
6.5. Do Not Track. Some browsers offer a “Do Not Track” (DNT) setting. Because there is no common industry standard for interpreting DNT signals, the Site does not currently respond to DNT signals. We do, however, honor the Global Privacy Control signal as described in Section 14.

7.1. Merchco will not sell or transfer your Personal Information to any nonaffiliated entity for that entity’s own independent direct-marketing use unless we provide clear notice to you and obtain your consent. Where you have agreed, Merchco may use advertising and analytics partners to measure the effectiveness of, and to deliver, advertising for Merchco on other websites and platforms.
7.2. From time to time, Merchco may contact you by email to provide announcements, newsletters, promotional offers, surveys, and other communications. If you no longer wish to receive marketing or promotional communications from Merchco, you may opt out by using the unsubscribe link at the bottom of any marketing email, by using the contact form at https://merchcoservices.com/contact-us/, or by contacting us using the details in Section 19.
8.1. Because the Site does not offer user accounts, you cannot edit your information through an online profile. If you have submitted information to us and would like to access, update, correct, or delete it, you may contact us using the contact form at https://merchcoservices.com/contact-us/ or the details in Section 19, and we will respond consistent with this Privacy Policy and applicable law.
8.2. Merchco wants to keep only accurate and up-to-date information in its records. If you believe information we hold about you needs to be corrected or updated, please contact us and we will make reasonable efforts to do so, subject to any legal recordkeeping obligations.
The Site may include social-media features and plugins (for example, links or icons for platforms such as Facebook, Instagram, LinkedIn, or YouTube). When you interact with these features, the operator of the social-media platform may place a cookie on your device and may receive information about your visit, subject to the consent requirements in Section 6. Your interactions with these features are governed by the privacy policy of the platform that provides them.
The Site may contain links to other websites. Merchco is not responsible for the content or privacy practices of those sites. We encourage you to be aware when you leave our Site and to read the privacy policy of any other website that collects your Personal Information.
11.1. Merchco takes reasonable administrative, technical, and physical steps to protect the Personal Information we collect through the Site from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. Where information is transmitted to or from the Site, we use encryption in transit (such as Transport Layer Security) where appropriate.
11.2. Nevertheless, no method of transmission over the internet or method of electronic storage is completely secure, and Merchco cannot guarantee the absolute security of your Personal Information. You acknowledge that (a) there are security and privacy limitations inherent to the internet that are beyond our control, and (b) the security, integrity, and privacy of information exchanged between you and us cannot be guaranteed. To the fullest extent permitted by law, Merchco disclaims liability for loss, misuse, or unauthorized access, disclosure, alteration, or destruction of information beyond our reasonable control. We recommend that you take available precautions to protect the information you submit.
12.1. We retain Personal Information for as long as needed or permitted in light of the purpose for which it was collected and consistent with applicable law. We determine the retention period based on: (a) the time the Personal Information is needed to fulfill the purposes described in this Privacy Policy (for example, to respond to your inquiry or to send communications you have requested); (b) whether you have asked us to delete it or to stop contacting you; and (c) our legal, tax, accounting, and recordkeeping obligations, and the need to establish, exercise, or defend legal claims. When Personal Information is no longer needed, we will delete, de-identify, or securely dispose of it.
Before you provide Personal Information to Merchco, we provide you with notice (including through this Privacy Policy and, at the point of collection, through our contact and sign-up forms) about the purposes for which we collect and use Personal Information, the categories of third parties to which we disclose it, and the choices and means by which you can limit its use and disclosure. Where we intend to use or disclose your Personal Information for a materially different purpose than the one for which it was collected, we will provide notice. Your primary controls are the cookie-consent banner (for tracking technologies), the unsubscribe mechanism (for marketing email), and the rights described in Sections 14 and 15.
14.1. Your rights with respect to your Personal Information depend on the state in which you reside. We will not unlawfully discriminate against you for exercising any of these rights. Depending on your state of residence and subject to applicable exceptions, these rights may include one or more of the following:
14.1.1 The right to confirm whether we process your Personal Information and to access it;
14.1.2 The right to correct inaccurate Personal Information;
14.1.3 The right to request deletion of Personal Information we have collected from you;
14.1.4 The right to obtain a portable copy of your Personal Information;
14.1.5 The right to opt out of targeted advertising, the “sale” of Personal Information, and, where applicable, the “sharing” of Personal Information for cross-context behavioral advertising; and
14.1.6 The right to appeal a denial of a request and to contact your state Attorney General.
14.2 Rights by State of Residence. Residents of California (under the CCPA/CPRA), Virginia (under the Virginia Consumer Data Protection Act), Colorado (under the Colorado Privacy Act), Connecticut (under the Connecticut Data Privacy Act), and Texas (under the Texas Data Privacy and Security Act, Tex. Bus. & Com. Code ch. 541) each have privacy rights under their respective state laws. Residents of other states with comprehensive privacy laws may have similar rights. The specific rights available to you, and the exceptions that apply, are determined by the law of your state of residence. California residents should also review Section 15, which contains our Notice to California Residents and Notice at Collection.
14.3 Global Privacy Control and Universal Opt-Out. We honor the Global Privacy Control (“GPC”) signal transmitted from a supported browser or extension as a valid request to opt out of the “sale” and “sharing” of Personal Information and of targeted advertising, to the extent required by the CCPA/CPRA, the Texas Data Privacy and Security Act (which requires businesses to recognize universal opt-out mechanisms), and other applicable state laws. Because the Site does not require you to log in, we apply an opt-out signal to the browser or device from which it is received.
14.4 How to Exercise Your Rights. To exercise any of these rights, you may (a) submit the contact form at https://merchcoservices.com/contact-us/, (b) email us at privacy@merchcoservices.com, (c) call us at 888.879.8813, or (d) write to us at the address in Section 19. For opt-out-of-tracking requests, you may also use the cookie-consent banner or transmit a GPC signal. We will verify your request using information reasonably available to us and will respond within the time period required by your state’s law. You may use an authorized agent to submit a request on your behalf where permitted by law.
15.1. This Section supplements the rest of this Privacy Policy and applies to residents of the State of California. Merchco provides this notice to comply with the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together, “CCPA/CPRA”). To the extent this Section conflicts with the rest of this Privacy Policy, this Section governs for California residents.
15.2. Notice at Collection. At or before the point at which we collect your Personal Information, we collect the following categories of Personal Information for the following purposes:
15.3. Identifiers (name, email address, telephone number, IP address, and online identifiers) collected to respond to your inquiries, to send communications you request, to operate and secure the Site, and for analytics and marketing.
15.4. Internet or Other Electronic Network Activity Information (browsing and interaction data collected through cookies, GA4, and Hotjar) collected, subject to your consent, for analytics, to improve the Site, and for advertising.
15.5. Commercial and Communications Information (the content of your messages and your communications preferences) collected to respond to you and to manage our communications with you.
15.6. Inferences (preferences and interests derived from the above) used to improve the Site and to deliver relevant marketing.
15.7. We retain each category for the period described in Section 12. We do not collect or use sensitive Personal Information for purposes that would trigger the right to limit its use, and we do not knowingly sell or share the Personal Information of consumers under 16 years of age.
15.8. Sale and Sharing. Merchco does not sell your Personal Information for monetary consideration. However, our use of advertising and analytics Cookies may constitute a “sale” or “sharing” of Personal Information under the CCPA/CPRA. You have the right to opt out of such “sale” or “sharing,” which you may exercise through the cookie-consent banner, by transmitting a GPC signal, or by contacting us as described in Section 14.4.
15.9. Your California Rights. Subject to the exceptions in the CCPA/CPRA, California residents have the right to: (a) know what Personal Information we collect, use, disclose, and sell or share; (b) request deletion of Personal Information we collected from them; (c) request correction of inaccurate Personal Information; (d) opt out of the sale or sharing of Personal Information; (e) limit the use and disclosure of sensitive Personal Information; and (f) not be discriminated against for exercising these rights. You may also appeal a denial and contact the California Privacy Protection Agency or the California Attorney General.
15.10. To exercise any of these rights, contact us using the methods in Section 14.4. We will verify your request using information reasonably available to us, which may include matching information you provide with information already in our records.
From time to time, Merchco may revise this Privacy Policy to reflect changes to our business, the Site, or applicable law. If a change requires advance notice under applicable law, we will provide it; otherwise, changes will be reflected on this page and take effect when posted. We recommend that you review this Privacy Policy regularly. Your continued use of the Site after any change indicates your acceptance of the revised Privacy Policy. The date on which this Privacy Policy was last revised appears at the top.
The Site is not designed or intended for use by children under the age of 13. We do not knowingly collect Personal Information from anyone under the age of 13 without verifiable parental consent in accordance with the Children’s Online Privacy Protection Act. If you are under 13, please do not submit any Personal Information through the Site. If we learn that we have collected Personal Information from a child under 13 without the required consent, we will delete it. You must be at least 18 years of age to submit information through the Site.
The Site is directed to users who reside in the United States. It is not our intent to collect Personal Information from individuals residing outside the United States through this Site. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, and you understand that your information will be processed in the United States.
